Terms of Service

These terms govern your use of Vaerly, including its website-building, hosting, voice, lead, and subscription features.

1. Using Vaerly

You must be legally able to enter a contract and provide accurate account information. You are responsible for activity under your account and for keeping access to your phone number secure. Vaerly may use one-time text messages to verify your account. These messages are transactional, not marketing, and carrier charges may apply.

2. The service

Vaerly helps you create, revise, host, and publish a business website using voice and typed instructions. A founder-assisted build can help you prepare the first version, but you remain responsible for reviewing the website before publishing and for keeping its business information accurate.

The initial service includes one hosted Vaerly subdomain website. Custom domains, complex bookings, ecommerce, memberships, and other integrations are not included unless Vaerly confirms otherwise in writing.

3. Subscriptions, cancellation, and refunds

Paid plans renew monthly at the price shown when you subscribe, currently US$19.99 per month for the founding plan, plus applicable taxes. Stripe processes payments. You authorize recurring charges until you cancel.

You can cancel through the billing controls in Vaerly. Cancellation takes effect at the end of the paid billing period, and the plan remains active until then. Payments are generally non-refundable and we do not provide prorated refunds, except where required by law or where Vaerly confirms otherwise.

4. Your content and responsibilities

You keep ownership of the business information, images, text, and other content you provide. You give Vaerly a limited licence to process, modify, store, display, and distribute that content only as needed to operate and improve the service and publish your website.

You must have the rights and permissions needed for your content and business claims. You are also responsible for responding lawfully to website leads and for any industry-specific disclosures, licences, accessibility duties, privacy notices, or consents that apply to your business.

5. Acceptable use

You may not use Vaerly to:

  • Break the law, infringe rights, deceive visitors, or impersonate another person or business.
  • Publish malware, abusive material, illegal goods or services, or content that creates a safety risk.
  • Probe, disrupt, overload, reverse engineer, or bypass security or access controls.
  • Send spam, collect information unlawfully, or use leads outside the purpose for which they were submitted.

6. AI output

Vaerly uses artificial intelligence, which can produce incomplete or inaccurate text, images, layouts, or suggestions. Output may not be unique. You must review the website and confirm that claims, contact details, prices, images, and legal information are correct before and after publishing.

7. Availability and changes

We work to keep Vaerly available, but do not promise uninterrupted service or permanent storage. We may change, suspend, or discontinue features for security, legal, technical, or business reasons. We will provide reasonable notice when a material change affects a paid service and notice is practical.

8. Suspension and termination

You may stop using Vaerly at any time. We may suspend or terminate access for non-payment, abuse, a security risk, or a material breach of these terms. When a paid plan ends, the published site may be disabled and content may be deleted after a reasonable retention period.

9. Disclaimers and liability

To the extent permitted by law, Vaerly is provided “as is” and “as available” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Vaerly is not responsible for indirect, incidental, special, consequential, or lost-profit damages.

To the extent permitted by law, Vaerly's total liability for claims relating to the service will not exceed the amount you paid Vaerly during the three months before the event giving rise to the claim. Nothing here limits a right or remedy that cannot legally be limited.

10. Governing law and contact

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Courts located in Toronto, Ontario will have exclusive jurisdiction unless applicable consumer law requires otherwise. Questions can be sent to mo@magitek.app.
